TERMS OF SERVICE & SERVICE AGREEMENT

1. Acceptance of Terms

By accessing or using any SMAHOO platform, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must discontinue use.

2. Nature of Services

SMAHOO provides educational, creative, wellness-oriented, and life-skills services. These include digital content, live experiences, coaching, arts-based learning, and AI-supported tools.

IMPORTANT:
SMAHOO does not provide medical, psychiatric, or emergency services. Content is non-clinical, non-diagnostic, and not a substitute for professional care.

3. User Responsibilities

You agree to:

Use services lawfully and respectfully
Provide accurate information
Maintain confidentiality of your account credentials
Refrain from harassment, abuse, or misuse of the platform
Take personal responsibility for your choices and interpretations of content

Participation is voluntary
Outcomes vary by individual
You remain responsible for seeking professional support where needed

5. Intellectual Property

All content within the SMAHOO ecosystem—including text, audio, video, curriculum, frameworks, trademarks, and methodologies—is the exclusive intellectual property of SMAHOO, unless otherwise stated.

You may not:

Reproduce, distribute, or commercialize content without permission
Reverse-engineer proprietary systems
Misrepresent SMAHOO materials as your own

6. Payments, Subscriptions, and Refunds

Fees, billing cycles, and refund policies are disclosed at point of purchase
Subscription services may renew automatically unless cancelled
SMAHOO reserves the right to update pricing with notice

7. Platform Access and Availability

We strive for continuous access but do not guarantee uninterrupted service. Maintenance, updates, or unforeseen disruptions may occur.

8. Termination of Access

We reserve the right to suspend or terminate access where:

Terms are violated
Misuse or harm is identified
Legal or safety risks arise

Users may terminate their accounts at any time.

9. Limitation of Liability

To the fullest extent permitted by law:

SMAHOO is not liable for indirect, incidental, or consequential damages
Use of services is at your own risk
Liability is limited to amounts paid for services, where applicable

You agree to indemnify and hold harmless SMAHOO from claims arising from your misuse of the platform or violation of these Terms.
